Lotte Cultural Foundation Terms of Use
Chapter 1. General Provisions
Article 1. (Purpose)
The purpose of these Terms of Use is to set forth the terms and procedures under which users (hereinafter the "User") shall use the information service (hereinafter the "Service") provided by Lotte Cultural Foundation (hereinafter the "Foundation").
Article 2. (Effect & Amendment)
- ① These Terms of Use shall be effective upon placement on the service menu.
- ② The Foundation may amend these Terms of Use if material cause is present or deemed necessary to the extent permitted under the applicable laws including the Framework Act on Electronic Commerce, Digital Signature Act, Act on Promotion of Information and Communications Network Utilization and Consumer Protection Act and in this case, the amended Terms of Use shall be announced immediately through the Announcement section.
- ③ The User may cease to use the Service and terminate the User Agreement if the User does not agree with such amendment. If the User continues to use the Service, it shall be deemed that the User clearly agrees to and accepts the amendment in whole.
Article 3. (Additional Rules)
Any matters not stipulated in these Terms of Use shall be determined in accordance with the applicable laws or commercial practice.
Chapter 2. Service Agreement
Article 4. (Constitution of Agreement & Application for Service)
- ① The Service Agreement shall be constituted if the User accepts these Terms of Use and applies for the Service and the Foundation approves the application.
- ② The User, whether an individual or an organization, shall complete the Membership Application Form provided by the Foundation and submit the form online to use the Service under Article 4-1 hereof.
- ③ All the information provided on the application form shall be deemed true and correct. If the User provides any false information, their rights may not be protected by the law and certain restrictions may apply to their use of the Service.
- ④ Under special circumstances where a large amount of the Service is required, a separate agreement may be entered into between the parties.
Article 5. (Withholding Approval of Service Agreement)

① The Foundation may withhold its approval for the Service Agreement if:
- 1. the service facilities cannot accommodate the User;
- 2. there is a technical difficulty in providing the Service; or
- 3. it is deemed necessary for smooth Service operation.

② The Foundation may reject the application if the User:
- 1. uses another person's name in the application;
- 2. provides false information in the application; or
- 3. intends to abuse the Service or cause disorder, harm or offence to society.
Chapter 3. Use of Service
Article 7. (Service Hours)
Unless required under operational procedure or technical difficulty, the Service shall be available 24 hours a day, 7 days a week. However, the Service may not be available during maintenance or at any time determined by the Foundation.
Article 8. (Login Information)
- ① The User shall be responsible for protecting its own username and password.
- ② The User shall not transfer or disclose their account to a third party without justifiable reason.
- ③ The User shall be responsible for any abuse of the Service by a third party or any damages caused by the misuse of their login information.
Article 9. (Restrictions on Use of Service & Termination of Service Agreement)
- ① To terminate the Service Agreement, the User shall request it online.

② The Foundation may terminate the Service Agreement or not provide the
Service, in part or whole, without prior notice if the User:
- 1. uses another person's account;
- 2. sends an excessive amount of information and causes a disruption to the Service;
- 3. sends advertising information or email message without the consent of recipients;
- 4. distributes a computer virus which causes a malfunction or destroys information;
- 5. is subject to restrictions under the Korea Communications Standards Commission;
- 6. is engaged in an illegal election campaign under the National Election Commission;
- 7. uses the Service for commercial purposes without permission from the Foundation;
- 8. violates the laws including Electronic Communications Act; or
- 9. is deemed by the Foundation inappropriate to continue using the Service.
Article 10. (Updating Personal Information)
- 1. The User may access or update their personal information.

2. The User shall update online any information they have provided in their
application form or the Service Agreement and shall be responsible for
any damages caused by not updating their information in a timely manner.
The following information in particular shall be updated by contacting
the Lotte Cultural Foundation/Lotte Concert Hall or online and the User
shall confirm whether it has been updated correctly:
- Address, phone no., email, etc.
Article 11. (Removal of Posts & Restrictions on Use of Service)
- ① The Foundation may remove any posts if deemed necessary due to limited space in its service facilities.
- ② The Foundation may restrict certain part of the Service if deemed necessary due to limited space in its service facilities.
- ③ In the event of Articles 11-1 and 11-2 hereof, the Foundation shall give prior notice online.

④ The Foundation may remove any posts or contents of the Service without
prior notice if such posts or contents:
- 1. are defamatory or slanderous to other Users or any third parties;
- 2. contain any information, sentences or graphics that are offensive or pornographic;
- 3. are related to anti-government, anti-social or criminal activities;
- 4. infringe the rights of other Users or any third parties;
- 5. have expired under the terms; or
- 6. violate any laws.
Article 12. (Discontinuation & Limitation of Service)

① The Foundation may discontinue the Service if:
- 1. the service facilities undergo repair or construction; or
- 2. the telecommunication service is not available under the Telecommunication Business Act.
- ② The Foundation may cease or limit its Service in the event of a national emergency or interruption or overloading of the service facilities.
Article 13. (Duties of the Foundation)
- ① The Foundation shall ensure that the User may use the Service upon application unless required otherwise.
- ② The Foundation shall provide the Service in a continuous and reliable manner and repair any interruption or failure of the Service immediately unless such interruption or failure is caused by a natural disaster or emergency situation and cannot be recovered on time.
- ③ The Foundation shall protect the User's privacy in compliance with these Terms of Use and the Service Agreement.
- ④ The Foundation shall provide its best efforts to ensure that the User may enter into, modify or terminate the Service Agreement at their convenience.
- ⑤ The Foundation shall keep the User informed of any changes or update to the Service by posting such information online on its service page.
Article 14. (Protection of Privacy)
- ① The Foundation shall keep any personal information provided by the User on its application and any additional personal information provided during the use of the Service under the Act on Promotion of Information and Communications Network Utilization.

② The User shall be deemed to have given their consent to the collection
and use of their personal information if they provide their personal
information. The Foundation may collect or use the personal information
of the User for the following purposes:
- 1. Provide the Service and execute the Service Agreement;
- 2. Create marketing information and customize the Service; or
- 3. Deliver promotional information.

③ The Foundation shall not disclose the User's personal information to
a third party without the consent of the User except in the following
circumstances:
- 1. Required by investigation of crimes with written demand to disclose the name, address and other personally identifiable information of the User;
- 2. Required under the Use and Protection of Credit Information Act and the Telecommunication Business Act;
- 3. Provide the information in unidentifiable format for the purpose of statistical data analysis, and academic or market research; or
- 4. Required by other applicable laws.
- ④ The User may access or update their personal information at any time in the same manner as the User applies for the Service and the detailed instructions shall be notified or provided in the service manual.
- ⑤ The User may withdraw their consent to the collection, use and disclosure to a third party of their personal information at any time by terminating the Service Agreement. The User may terminate the Service Agreement as provided in these Terms of Use separately.
Article 15. (Duties of the User)

① When using the Service, the User shall not:
- 1. use another User's account inappropriately;
- 2. duplicate, publish, broadcast or disclose to a third party any information obtained through the Service without prior written consent of the Foundation;
- 3. slander or defame other Users or any third parties;
- 4. distribute any information, sentences or graphics that are offensive or pornographic;
- 5. be engaged in any anti-government, anti-social or criminal activities;
- 6. infringe the rights of other Users or any third parties; or
- 7. violate any laws.
- ② The User shall comply with these Terms of Use and the Service Agreement and manual.
- ③ The User shall use the devices in compliance with the technical requirements of telecommunication systems and shall not cause any disruption to the Service operation.
Chapter 4. Copyright
Article 16. (Content Rights) The following rights apply to the contents available through the Service:
- 1. The User shall be responsible and have the rights to the contents they posted and the Foundation shall not use the contents for commercial purposes with the consent of the User. However, the Foundation may use the contents for non-commercial purposes. The Foundation shall have the right to post the User's contents on the Service.
- 2. The Foundation shall reserve the copyright of the contents it created. The User shall not duplicate, transmit, publish, broadcast, modify or sell any information obtained using the Service without prior consent of the Foundation or provide or use any contents posted on the Service for commercial purposes.
- 3. The User shall not modify or sell for commercial purposes any information or contents posted by other Users without their prior consent.
Article 17. (Claim & Compensation for Damages)
- 1. The Foundation shall not be responsible for any damages or losses caused to the User by any force majeure events including natural disasters.
- 2. Any claims for damages shall be in writing addressed to the Foundation specifying the grounds, amount of damages and proof.
Article 18. (Indemnification)
- 1. The Foundation shall not be responsible for any failure to obtain expected gains or any damages caused to the User in the course of using the Service unless it is directly caused by the Foundation.
- 2. The Foundation shall not be responsible for any failure to use the Service or any interruption of the Service which is caused by the User.
- 3. The Foundation shall not be responsible for any contents posted or transmitted by the User.
- 4. The Foundation shall not be responsible for any transactions taking place between the Users or any third parties through the Service.
Article 19. (Resolution of Dispute)
- 1. The Foundation and the User shall use their best efforts to settle any disputes regarding the Service in an amicable manner.
- 2. Any legal claim between the Foundation and the User regarding the electronic transaction shall be submitted to the court in the jurisdiction where the User resided at the time of raising the claim. If there is no address, the claim shall be submitted to the district court where its residence is within the jurisdiction. However, if the User's address or residence is not clear at the time of raising the claim, the jurisdiction shall be determined in accordance with the Civil Procedure Act.
